Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Flibony ("Flibony", "we", "us", or "our") and govern your access to and use of the Flibony mobile application, the website at https://flibony.com, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Community Guidelines. If you do not agree, do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. Eligibility and Age

You must meet the minimum age required in your country (and at least the age of digital consent where applicable) to use the Service. The Service is not intended for children. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to use a supported sign-in method (phone, Google, or Telegram), to keep your information accurate, and to notify us promptly of any unauthorized use. We may refuse, suspend, or terminate accounts as described in these Terms and our Community Guidelines.

4. License to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial enjoyment, except for features (such as host, creator, or agency programs) that we expressly make available for monetization under additional terms. You may not copy, modify, reverse engineer, scrape, resell, or create derivative works from the Service except as permitted by law.

5. Virtual Items — Coins, Diamonds, Gifts, and VIP

The Service offers virtual items, including Coins, Diamonds, Gifts, VIP memberships, and other digital goods and entitlements. You acknowledge and agree that:

• Virtual items are not redeemable for money except where we expressly permit it (for example, an eligible creator/agency payout) and only as required by applicable law, subject to verification (including KYC), fees, limits, and our separate payout terms.
• All purchases of virtual items are generally final and non-refundable, except where a refund is required by applicable law or the rules of the app store through which you purchased.
• We may manage, regulate, modify, limit, expire, or remove virtual items, pricing, exchange rates, and reward mechanics at any time, and we may take action against accounts that abuse or manipulate the virtual economy, gifts, leaderboards, or rewards.
• You have no right to transfer, sell, or trade virtual items outside the mechanisms we provide.

6. Purchases and Payments

Purchases may be processed through the Apple App Store, Google Play, or other payment providers, and are subject to their terms in addition to ours. You are responsible for all applicable taxes and for the payment method you use. Chargebacks, fraud, or abuse may result in loss of virtual items and account suspension.

7. User Content and License

You retain ownership of the content you create or upload ("User Content"). By submitting User Content, you grant Flibony a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, transmit, display, and distribute that content for the purpose of operating, promoting, and improving the Service. You represent that you have the rights necessary to grant this license and that your User Content does not violate the law or the rights of others. We may remove or restrict User Content that violates these Terms or our Community Guidelines.

8. Acceptable Use

You agree to use the Service in accordance with our Community Guidelines. Prohibited activity includes, without limitation, illegal content, sexual content involving minors, harassment, hate speech, threats or violence, fraud and scams, impersonation, spam, and any manipulation of the virtual economy, gifts, leaderboards, or anti-fraud systems. Violations may result in content removal, restrictions, suspension, or permanent termination.

9. Creators, Hosts, and Agencies

Certain features let you host rooms, build an audience, join or run an agency, and earn rewards. Participation may require eligibility checks, identity verification (KYC), and acceptance of additional program, contract, and payout terms. We may set, change, or revoke program terms, commission rates, ranks, and payout conditions, and we may suspend participation for policy or risk reasons. Rewards and payouts are subject to verification, taxes, fees, holding periods, and anti-fraud review.

10. Moderation and Enforcement

We are not obligated to pre-screen User Content but may monitor, review, and moderate the Service using automated and human systems. We may, at our discretion and without prior notice, remove content; mute, freeze, suspend, or ban accounts; reverse or withhold virtual items obtained through abuse; and report unlawful activity to authorities. Where we offer an appeals process, you may contest certain enforcement decisions.

11. Third-Party Services

The Service integrates third-party services (such as authentication, hosting, real-time communication, payments, and analytics). We are not responsible for third-party services, and your use of them is subject to their own terms and policies.

12. Intellectual Property

The Service, including its software, design, trademarks, and content we provide, is owned by Flibony or its licensors and is protected by intellectual-property laws. Except for the limited license granted to you, these Terms do not transfer any rights in the Service to you.

13. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content shared by users is accurate or appropriate.

14. Limitation of Liability

To the maximum extent permitted by law, Flibony and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or virtual items, arising from or related to your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100, except where this limitation is prohibited by law.

15. Indemnification

You agree to indemnify and hold harmless Flibony and its affiliates, officers, and employees from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or the rights of others.

16. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time for any violation of these Terms or our policies, for risk or legal reasons, or if required by law. Upon termination, your right to use the Service and any remaining virtual items ends, except where applicable law provides otherwise. Sections that by their nature should survive termination (such as virtual-item disclaimers, intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

17. Governing Law and Disputes

These Terms are governed by the laws applicable to Flibony's principal place of business, without regard to conflict-of-laws rules, except where mandatory local consumer-protection laws apply to you. You agree to first attempt to resolve any dispute with us informally by contacting support@flibony.com.

18. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
